Terms of Service
Effective date: October 4, 2026
B4RAW, a sole proprietorship based in Houston, Texas
These Terms of Service (“Terms”) govern access to and use of B4RAW, a sole proprietorship based in Houston, Texas, including the websites, applications, and related software we operate (the “Service”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Privacy Policy is a disclosure, not a separate contract requiring consent.
Definitions
- B4RAW, we, us, and our mean B4RAW, a sole proprietorship based in Houston, Texas, doing business under the trade name B4RAW.
- Service means the B4RAW software and related hosted features we make available for photography businesses.
- Customer or Tenant means the photography business or other organization that holds a B4RAW workspace.
- User means an individual who accesses the Service, including Tenant staff, invited collaborators, and client-portal users.
- Client means a customer or contact of a Tenant—not a customer of B4RAW—unless that person also has their own B4RAW account.
- Customer Content means content a Tenant or its Users submit to the Service, including photos, video, documents, branding, listings, descriptions, CRM and order information, and other uploaded files.
1. Eligibility
You must be at least 18 years old to create or administer a B4RAW account.
If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” includes that organization.
You must provide accurate account information and keep it reasonably current. We may refuse, suspend, or terminate access if these Terms are not met, or as described in Section 21.
The 18-year minimum applies to B4RAW account holders and administrators. It does not prohibit lawful professional photography or media that depicts children, families, newborns, or other minors. Tenants remain responsible for obtaining any parental or guardian permissions, releases, publication consent, and other authority their work requires.
B4RAW prohibits sexual exploitation of minors and unlawful sexual content involving minors.
2. Account security
You are responsible for your login credentials and for activity that occurs under your account, except to the extent caused by our failure to provide the Service.
Do not share credentials beyond authorized Users for your Tenant. Each person who should have access should use their own account where the Service provides one.
Notify us promptly at [email protected] if you believe an account has been used without authorization or if you need to report a security or abuse incident.
We may use reasonable authentication and security measures. Those measures do not transfer responsibility for your credentials or for how your Tenant grants access to staff, providers, or Clients.
3. B4RAW as a platform
B4RAW provides software and infrastructure for photography businesses. We help Tenants run operations such as orders, files, delivery, communications, and related workspace tools.
B4RAW is not, merely by providing the Service:
- the photographer, videographer, or editor on a Tenant’s job;
- a real-estate agent or other licensed professional for a Tenant’s client work;
- the Tenant’s employer or the Client’s service provider;
- a guarantor of Tenant–Client payments or results; or
- a body that independently certifies licenses, insurance, or professional credentials.
If a Tenant records provider or compliance information in the Service, that is Tenant-managed information. B4RAW does not independently verify those credentials.
The Tenant remains responsible for its own photography or production services and for its relationships with Clients, staff, and providers.
4. Tenant responsibilities
The Tenant is responsible for its lawful use of the Service and for the data and content it and its Users put into the Service, including:
- Client and CRM information;
- obtaining permissions and consents the Tenant needs for its own business (including communications, model releases, and publication);
- booking, order, scheduling, and property or access instructions;
- messages the Tenant sends through the Service;
- uploaded media and documents;
- who it invites as Users and what they can access;
- what it chooses to publish publicly; and
- laws that apply to its own photography, advertising, employment, and client relationships.
Intimate or sensitive content must be handled responsibly. The Tenant must have consent and authority before publishing such content. B4RAW may restrict public display of sexually explicit adult or other sensitive content, as described in Section 8.
B4RAW does not guarantee that a Tenant’s use of the Service will satisfy the Tenant’s legal or professional obligations.
5. Acceptable use
You may not use the Service to:
- violate applicable law;
- infringe intellectual-property or other rights;
- upload unlawful, harmful, or malicious content;
- harass, threaten, or abuse others;
- distribute malware or attempt to compromise systems;
- probe, scan, or attack the Service except with our prior written permission;
- bypass authentication or authorization;
- access another Tenant’s workspace or data without authorization;
- abuse email, SMS, or other messaging features, including unlawful spam;
- impersonate another person or misrepresent affiliation;
- misuse payment features; or
- use automated scraping or load-generation that materially harms the Service.
Professional adult photography
Lawful, consensual professional adult photography may be hosted, including boudoir, fine-art nude, and similar legitimate professional work. B4RAW does not treat all nudity as prohibited pornography.
You may not use the Service for:
- unlawful sexually explicit content;
- sexual exploitation;
- sexual content involving exploitation of minors;
- non-consensual intimate imagery;
- revenge porn or intimate imagery shared without authorization;
- content whose purpose or use is unlawful harassment, threats, humiliation, or unlawful public exposure of a person; or
- other clearly illegal sexual content.
The Tenant remains responsible for lawful collection, consent, model releases or permissions where appropriate, and publication rights.
6. Customer Content
Customer retains whatever ownership and rights it already has in Customer Content. B4RAW does not claim ownership of Customer Content.
You represent that you have sufficient rights and permissions to upload, process, store, and—where you choose—publish or deliver Customer Content through the Service, and that doing so does not violate law or third-party rights.
You are responsible for Customer Content. We reserve the enforcement rights in Section 21.
7. Limited license to B4RAW
You grant B4RAW a limited, non-exclusive, worldwide (only as technically needed), royalty-free license to host, store, copy for technical purposes, process, resize, transcode, display, transmit, create previews or watermarks, back up, and distribute Customer Content solely as needed to operate, provide, support, and improve the Service, including when you instruct publication or delivery to Users, Clients, or providers.
This license is not a sale or transfer of ownership.
This license does not allow B4RAW to use Customer Content automatically in B4RAW’s own website marketing, social posts, ads, case studies, portfolio, or promotional campaigns. If B4RAW wants to feature a Tenant’s photo, video, or other content for marketing, B4RAW will obtain separate explicit permission.
This license does not authorize B4RAW to use Customer Content to train general-purpose B4RAW or third-party AI or machine-learning models without explicit permission.
8. Public content
Some features let a Tenant publish listings, portfolios, galleries, booking pages, or other presentation content on public URLs.
The Tenant decides what to make public and must have the necessary permissions. Once published, that content may be available to anyone with the link and may be accessed, copied, cached, or indexed by third parties, including search engines.
B4RAW does not promise how search engines will index, display, or remove public content. We do not claim that every public page is indexed.
Even when lawful, consensual adult photography may be hosted for professional purposes, B4RAW may restrict sexually explicit adult content from public-facing B4RAW pages so those surfaces remain appropriate for general professional use.
9. Copyright and intellectual-property complaints
Send copyright, takedown, and other intellectual-property complaints to [email protected]. Include:
- identification of the copyrighted work or right claimed to be infringed;
- the location or a reasonably specific description of the content;
- your name, email, and mailing contact if you have one you are willing to provide;
- a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and
- a statement that the information in the complaint is accurate and that you are the owner or authorized to act for the owner.
We may investigate and may temporarily restrict or remove content where appropriate. This section describes a complaint process. It does not state that B4RAW has a registered copyright agent or that any particular safe-harbor statute applies.
10. Third-party services
The Service may work with third-party providers, such as payment processors, email or SMS providers, hosting and storage providers, and maps or calendar services.
Those providers have their own terms and privacy practices. B4RAW is not responsible for outages or actions of independent third parties except to the extent applicable law requires.
See our Privacy Policy for information about how we use personal data with service providers.
11. Payments and platform subscriptions
Some features require a paid B4RAW subscription. Current pricing, plan details, and billing cycle are shown at purchase or in your billing controls.
If you start a paid plan, you authorize B4RAW and its payment provider to charge the payment method you select for recurring fees and applicable taxes until you cancel in accordance with these Terms and the billing controls.
Paid plans renew for successive billing periods until canceled. If a payment fails, we may retry the charge and may limit or suspend access after any applicable handling or grace period.
B4RAW does not store raw card numbers. Payment credentials are processed by the payment provider.
12. Cancellation
You may cancel a paid B4RAW subscription at any time through the applicable billing controls.
Cancellation takes effect at the end of the current paid billing period. Access to paid features normally continues through that paid period, subject to these Terms and ordinary account rules.
Cancellation changes billing and, when the period ends, paid access. It does not automatically delete your workspace or Customer Content. Deletion and retention are separate, as described in Section 19.
13. Refunds
Fees already paid to B4RAW for a subscription period are non-refundable, except where applicable law requires otherwise.
We do not promise prorated refunds or credits. B4RAW may, in its discretion, issue a credit or refund in a particular case. That does not create an entitlement to a credit or refund in other cases.
14. Tenant-to-Client payments
A Tenant’s subscription fees paid to B4RAW are separate from amounts a Tenant charges its own Clients.
If the Service supports Tenant checkout or invoice-payment flows, the commercial transaction is between the Tenant and its Client. The Tenant is responsible for its pricing, services, taxes, Client refunds, and Client disputes, except for the payment-collection functionality B4RAW specifically provides.
The payment provider processes payment credentials. B4RAW is not the merchant of record for Tenant–Client charges unless a separate written agreement says otherwise.
15. Communications
We may send transactional and service emails, including account, security, billing, important account-change, assignment, workflow, and other service-operation messages.
Tenants may send Client or team communications through the Service. The Tenant is responsible for having appropriate permission or consent for messages it initiates.
If B4RAW later sends promotional email, those messages should include an applicable unsubscribe control. Unsubscribing from marketing does not turn off necessary transactional or service messages.
SMS is available only where we have enabled it and where the Tenant and recipient are permitted to use it. SMS is not enabled for every workflow. Do not assume a text message will be sent unless the Service shows that channel as available and permitted.
16. Privacy
Use of the Service is also subject to our Privacy Policy.
The Privacy Policy is a disclosure of how we handle information. It is not a substitute for these Terms and is not a separate contract requiring consent.
17. Service changes
We may modify, improve, add, or remove features, change interfaces, or discontinue functionality when we reasonably need to operate or evolve the Service.
We do not promise that any particular feature will remain available.
18. Availability and maintenance
We aim to provide a reliable Service. The Service may be interrupted for maintenance, third-party outages, security events, or technical failures.
Unless we agree in a separate written document, we do not provide an uptime service-level commitment.
19. Data, backups, retention, and account closure
We use technical systems to store Customer Content and account data and to apply security measures appropriate to a hosted business application.
You remain responsible for keeping copies of content and records that are critical to your business. The Service is not a substitute for your own backup of irreplaceable work.
Cancellation is not deletion. Canceling a subscription changes billing and access. It does not automatically delete Tenant data. B4RAW may retain information after cancellation for operational needs, reactivation, security, backups, legal obligations, fraud prevention, accounting, or disputes. We do not promise a fixed universal deletion period.
Backups. B4RAW may keep backups for continuity, recovery, and security. Backups are not a guaranteed personal archive. We do not guarantee recovery of every individual file. A backup may temporarily contain information that has been deleted from primary systems.
Account closure. Requests for permanent account closure may be sent to [email protected]. We may verify identity and authority to close the applicable account or Tenant. We may retain information required for legal, accounting, fraud, security, dispute, or backup purposes, and may delete or anonymize other information when appropriate and operationally feasible. We do not promise total immediate deletion, a universal wipe, or immediate deletion from backups.
We do not promise permanent storage, automatic complete deletion, guaranteed recoverability, or a tenant-wide export of all Tenant data.
If you need help with a legal or account-closure request, contact [email protected].
20. Law-enforcement and legal requests
B4RAW may disclose information when required by valid legal process, a court order, a subpoena, or another legally binding request. Where lawful and reasonable, we intend to limit disclosure to what is necessary and to notify the affected Customer where permitted. We may preserve information when subject to a lawful preservation obligation. We do not promise advance notice in every case.
21. Content enforcement, suspension, and termination by B4RAW
For clearly prohibited, illegal, dangerous, or high-risk content or use, we may disable access, restrict or remove content, or suspend an account, including without prior notice where reasonably necessary.
For ambiguous or disputed content, we may temporarily restrict publication or access, review the circumstances, request information, and—where appropriate—allow a reasonable explanation or appeal before permanent termination. We do not promise an appeal in every emergency or legally required case.
This is a reserved enforcement right.
We may also suspend or terminate access, in whole or in part, if we reasonably believe it is needed because of a material violation of these Terms, unlawful use, a security risk to the Service or other customers, nonpayment, abuse of the Service, or a legal requirement.
Effects may include loss of access to the Service and to Customer Content through the Service. We do not commit to a specific deletion timeline when access ends.
22. Your termination
You may stop using the Service and may cancel a paid subscription as described in Section 12.
Stopping use or canceling billing is not a promise that we will erase all data. For legal or account-closure matters, contact [email protected].
23. B4RAW intellectual property
The Service—including software, interfaces, documentation, designs, and the B4RAW name and marks—is owned by B4RAW or its licensors. These Terms do not transfer that ownership.
Subject to these Terms and your authorized access, we grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription or permitted access period.
Customer Content is addressed in Sections 6 and 7 and is not claimed as B4RAW-owned content.
24. Feedback
If you voluntarily send product ideas or feedback, B4RAW may use that feedback without obligation to you. Feedback does not transfer ownership of Customer Content and is not a license to use Customer Content in B4RAW marketing.
25. Preview features
We may offer preview or experimental features. Those features may change or end without notice and may be incomplete. They are provided as available and are not a commitment to a future product.
26. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available.” We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that it will meet a particular business result.
You are responsible for professional and business decisions you make using the Service. We do not warrant third-party services or Customer Content.
Some jurisdictions do not allow certain disclaimers. In those places, this section applies only to the extent permitted.
27. Limitation of liability
To the maximum extent permitted by applicable law, B4RAW will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if we have been advised of the possibility of those damages.
To the maximum extent permitted by applicable law, B4RAW’s aggregate liability arising out of or relating to the Service or these Terms will not exceed the fees paid to B4RAW by the applicable Customer during the 12 months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations. In those places, this section applies only to the extent permitted.
28. Indemnification
You will defend and indemnify B4RAW against claims, damages, and reasonable legal fees arising from matters controlled by the Tenant, including: Customer Content; lack of necessary rights or permissions; intellectual-property infringement caused by Tenant content or its publication; unlawful Tenant use of the Service; unlawful communications initiated by the Tenant; and disputes arising from the Tenant’s own professional services or relationships with its Clients, staff, or providers.
This indemnity does not require the Tenant to indemnify B4RAW for B4RAW’s own misconduct, or for a claim that the Service itself, unused with Tenant content, infringes.
29. Governing law and venue
These Terms are governed by the laws of the State of Texas, excluding conflict-of-law rules.
The exclusive venue for disputes arising out of or relating to these Terms or the Service is the state or federal courts sitting in Harris County, Texas.
These Terms do not require arbitration and do not include a waiver of class or collective actions.
30. Notices
Legal or contractual notices to B4RAW may be sent to [email protected].
B4RAW may send account or legal notices to the primary email associated with the Customer or account.
Specific law may require additional notice or service methods. Email notice does not override a mandatory legal-service requirement.
31. Changes to these Terms
We may update these Terms.
Editorial or minor changes do not necessarily require a new acceptance. For a material change—such as a significant change to fees or billing commitments, liability, dispute rules, customer obligations, or major content or use restrictions—we will provide a reasonable form of notice, and we may require acceptance of the new version before continued use.
